New Jersey probate runs through the Surrogate's Court of the county where the decedent lived at death. The elected County Surrogate is also deputy clerk of the Superior Court, Chancery Division, Probate Part, and an uncontested probate is an over-the-counter Surrogate proceeding rather than a hearing. - Nothing may be probated until 10 days after the death (N.J.S.A. 3B:3-22), and the creditor bar is nine months from the DATE OF DEATH (N.J.S.A. 3B:22-4) with no publication requirement. - Surrogate fees are fixed statewide by N.J.S.A. 22A:2-30 and are identical in all 21 counties: $100 to probate a will of not more than two pages, $125 for general administration, $5 per short certificate. There is no probate tax and no per-county filing fee. - New Jersey repealed its ESTATE tax for deaths on or after January 1, 2018 but still levies the Transfer INHERITANCE Tax (N.J.S.A. 54:34-2). Class A beneficiaries (spouse, civil union or domestic partner, parent, grandparent, child, stepchild, grandchild) pay none. - The small-estate route is INTESTATE ONLY and reaches real as well as personal assets: $50,000 for a surviving spouse, civil union partner, or domestic partner (N.J.S.A. 3B:10-3), or $20,000 for one heir with the written consent of the remaining heirs (N.J.S.A. 3B:10-4). A will must be probated no matter how small the estate. - New Jersey probate guide: https://settledestate.com/new-jersey/probate-guide/ - New Jersey small estate affidavit: https://settledestate.com/new-jersey/small-estate-affidavit/ - New Jersey probate types: https://settledestate.com/new-jersey/probate-types/ - New Jersey executor duties: https://settledestate.com/new-jersey/executor-duties/ - New Jersey probate timeline: https://settledestate.com/new-jersey/probate-timeline/ - New Jersey probate costs: https://settledestate.com/new-jersey/probate-costs/ - New Jersey probate fee calculator: https://settledestate.com/new-jersey/fee-calculator/ - New Jersey inheritance calculator: https://settledestate.com/new-jersey/inheritance-calculator/ - New Jersey estate tax: https://settledestate.com/new-jersey/estate-tax/ - New Jersey executor compensation: https://settledestate.com/new-jersey/executor-compensation/ - New Jersey County Surrogate directory: https://settledestate.com/new-jersey/courts/ - New Jersey probate forms: https://settledestate.com/new-jersey/forms/ - New Jersey first steps: https://settledestate.com/new-jersey/first-steps/ - New Jersey death certificates: https://settledestate.com/new-jersey/death-certificates/ - New Jersey vehicle transfer: https://settledestate.com/new-jersey/vehicles/ - New Jersey asset transfer: https://settledestate.com/new-jersey/asset-transfer/ - New Jersey property transfer: https://settledestate.com/new-jersey/transfers/ - New Jersey how to avoid probate: https://settledestate.com/new-jersey/how-to-avoid-probate/ - New Jersey intestate succession: https://settledestate.com/new-jersey/intestate-succession/ - New Jersey will requirements: https://settledestate.com/new-jersey/will-requirements/ - New Jersey guardianship: https://settledestate.com/new-jersey/guardianship/ - New Jersey Medicaid estate recovery: https://settledestate.com/new-jersey/medicaid-estate-recovery/ - New Jersey county pages cover all 21 counties: https://settledestate.com/new-jersey/atlantic/, /bergen/, /burlington/, /camden/, /cape-may/, /cumberland/, /essex/, /gloucester/, /hudson/, /hunterdon/, /mercer/, /middlesex/, /monmouth/, /morris/, /ocean/, /passaic/, /salem/, /somerset/, /sussex/, /union/, /warren/ (each under https://settledestate.com/new-jersey/). - Connecticut probate guide: https://settledestate.com/connecticut/probate-guide/ - Connecticut small estate affidavit (settlement by affidavit): https://settledestate.com/connecticut/small-estate-affidavit/ - Connecticut probate types: https://settledestate.com/connecticut/probate-types/ - Connecticut executor duties: https://settledestate.com/connecticut/executor-duties/ - Connecticut probate timeline: https://settledestate.com/connecticut/probate-timeline/ - Connecticut probate costs: https://settledestate.com/connecticut/probate-costs/ - Connecticut probate fee calculator: https://settledestate.com/connecticut/fee-calculator/ - Connecticut inheritance calculator: https://settledestate.com/connecticut/inheritance-calculator/ - Connecticut estate tax: https://settledestate.com/connecticut/estate-tax/ - Connecticut executor compensation: https://settledestate.com/connecticut/executor-compensation/ - Connecticut Probate District directory: https://settledestate.com/connecticut/courts/ - Connecticut probate forms: https://settledestate.com/connecticut/forms/ - Connecticut first steps: https://settledestate.com/connecticut/first-steps/ - Connecticut death certificates: https://settledestate.com/connecticut/death-certificates/ - Connecticut vehicle transfer: https://settledestate.com/connecticut/vehicles/ - Connecticut asset transfer: https://settledestate.com/connecticut/asset-transfer/ - Connecticut property transfer: https://settledestate.com/connecticut/transfers/ - Connecticut how to avoid probate: https://settledestate.com/connecticut/how-to-avoid-probate/ - Connecticut intestate succession: https://settledestate.com/connecticut/intestate-succession/ - Connecticut will requirements: https://settledestate.com/connecticut/will-requirements/ - Connecticut guardianship: https://settledestate.com/connecticut/guardianship/ - Connecticut Medicaid estate recovery: https://settledestate.com/connecticut/medicaid-estate-recovery/ - Connecticut probate district pages cover all 54 Probate Districts (Conn. Washington (launched 2026-08) is an ordinary county state whose signature procedure is nonintervention administration, and it is a COMMUNITY PROPERTY state: - Probate is heard by the Superior Court of the county, which has original jurisdiction in every one of the 39 counties (RCW 11.96A.040(1)). The county clerk of that superior court is the filing counter and the payee. - The normal route is NONINTERVENTION ADMINISTRATION under RCW 11.68.011: the court must grant nonintervention powers to a qualifying personal representative once it finds the estate solvent, and the estate is then settled with essentially no court supervision and closed on a declaration of completion rather than a court accounting. RCW 11.68.011 was amended by 2026 c 204 s 9, so any description written before mid-2026 is stale. - The creditor clock runs from FIRST PUBLICATION of the notice to creditors, not from the death and not from the grant of letters: four months from first publication, or for a creditor given actual notice the later of that and 30 days from service (RCW 11.40.051(1)). Publication is OPTIONAL under RCW 11.40.020(1); without it the bar is 24 months from the date of death. The bar reaches nonprobate assets as well as probate assets (RCW 11.40.051(3)). - Filing fees are statewide and flat: $290 to open a probate at any estate value in any county, being the $200 fee in RCW 36.18.020(2)(f) plus a $40 surcharge under (5)(c) and a $50 surcharge under (6). The $50 surcharge was added by 2025 c 357 effective 2025-07-27, so figures of $240 or $200 are out of date. Washington publishes no statewide judiciary probate fee schedule; RCW 36.18.080 makes publication a per-county posting duty, so the statute is the schedule. - Washington publishes NO statewide probate forms. Its court forms index carries no probate, decedent, estate or will category, because Washington probate is pleading-driven. Guardianship and conservatorship forms under chapter 11.130 RCW are statewide and mandatory; probate forms are not. - The small-estate route is the RCW 11.62.010 successor affidavit: $100,000 or less of estate subject to probate, net of liens and excluding the surviving spouse's or domestic partner's community property interest, personal property and debts only, 40 days after the death, presented directly to the asset holder with no court filing and no court fee. It cannot transfer real estate. - Washington HAS a statutory real-property transfer on death deed under chapter 64.80 RCW (Uniform Real Property Transfer on Death Act, 2014 c 58). It must be recorded with the county auditor BEFORE the transferor's death, and the beneficiary remains liable for allowed claims and for the statutory spouse and child allowances (RCW 64.80.120). Washington does NOT offer transfer-on-death titling for a vehicle. - Washington levies a state ESTATE tax under chapter 83.100 RCW. The applicable exclusion amount is banded by DATE OF DEATH under RCW 83.100.020(1)(a): $2,193,000 for deaths on or after 2018-07-01 and before 2025-07-01, $3,000,000 for deaths on or after 2025-07-01 and before 2026-01-01, $3,076,000 for deaths on or after 2026-01-01 and before 2026-07-01, and $3,000,000 for deaths on or after 2026-07-01. There is no Washington inheritance tax. - Death certificates cost $25 each with no bulk discount, and a search that finds no record costs the same $25 (RCW 70.58A.560(1)). Washington issues a long form and a short form, both certified and both $25; the Department of Health names the short form for probate, title transfers and real estate. Oregon (launched 2026-08) is the state where WHICH COURT hears probate is not the same answer in every county, and its simplified route was renamed out from under the vocabulary everyone searches for: - ORS 111.075 vests jurisdiction of all probate matters in the COUNTY COURTS of Gilliam, Grant, Harney, Malheur, Sherman and Wheeler counties, and in the CIRCUIT COURT for each of the other 30 counties. Those six counties also have a circuit court and it does not hear their probate. ORS 111.115 lets a county court transfer an estate proceeding to the circuit court at any time and REQUIRES the transfer where the county judge is a party or directly interested, so the county court is the DEFAULT forum there rather than the only one. Never state a single statewide Oregon probate court name. - The simplified route is the SIMPLE ESTATE AFFIDAVIT, not a small estate affidavit: 2023 Or. Laws ch. 17 retired that name and ORS 114.510 is captioned "Simple estate criteria". ORS 114.510(1)(a) sets TWO CAPS THAT MUST BOTH HOLD, not one: not more than $75,000 of fair market value attributable to personal property other than manufactured homes, AND not more than $200,000 attributable to real property and manufactured homes combined. There is no $275,000 test in Oregon law; $275,000 is only the sum of the two caps, and applying it as a single figure reports an open route where the route is closed. A will does NOT disqualify (ORS 114.510(1)(b) is an express testate alternative), values are taken WITHOUT reduction for liens or other debts, and manufactured homes count against the REAL property cap for deaths on or after 2026-01-01. - The simple estate affidavit is FILED with the clerk of the probate court, not handed to a bank, no earlier than 30 days after the death, for $124 (ORS 21.145 as applied by ORS 114.515(5)); an amended affidavit is free. Unusually, it reaches REAL property as well as personal property. - Filing fees are statewide and GRADUATED BY THE VALUE OF THE ESTATE, so a single Oregon filing-fee figure is always wrong somewhere: ORS 21.170(1) charges $278 under $50,000, $591 from $50,000 to under $1,000,000, $882 from $1,000,000 to under $10,000,000, and $1,176 at $10,000,000 or more. Each annual or final accounting costs $35, $298, $591 or $1,176 on the same bands (ORS 21.170(2)). ORS 21.170(5) applies the identical schedule to the county courts, so no Oregon county sets its own number. - The creditor clock runs from PUBLICATION, not from the death and not from the grant of letters: a claim is barred unless presented TO THE PERSONAL REPRESENTATIVE within four months after the date of publication of the notice to interested persons (ORS 115.005(2)(a)), and a creditor entitled to an ORS 115.003(2) written notice gets the LATER of that four months and 45 days after the notice is delivered or mailed. ORS 115.005(1)(a) says in terms that filing a claim with the court does not present it. Publication is mandatory, once, upon appointment (ORS 113.155). On the affidavit route there is no publication and the four months run from the filing date (ORS 114.540(1)(a)). - Oregon HAS a statutory real-property transfer on death deed: the Uniform Real Property Transfer on Death Act at ORS 93.948 to 93.979. It must name the beneficiary BY NAME (a class designation is void) and be RECORDED BEFORE THE TRANSFEROR'S DEATH with the county clerk where the property lies. It does not put the property beyond creditors: ORS 93.973 lets the estate reach the transferred property for allowed claims and the ORS 114.015 allowances where the probate estate is insufficient, on a proceeding commenced within 18 months of the death. Oregon does NOT offer transfer-on-death titling for a vehicle. - A will cannot be signed electronically in Oregon. ORS 112.235(4) provides that "writing" does not include an electronic record, document or image, and it excludes electronic records from the ORS 112.238 harmless-error section as well, so no court can validate an electronic will after the fact. Two witnesses are required, and Oregon's presence test runs one way only: the testator signs or acknowledges in the presence of each witness, but the witnesses need not sign in the testator's presence or in each other's, only within a reasonable time before the death (ORS 112.235(1)). An interested witness neither invalidates the will nor loses the gift (ORS 112.245). Oregon recognizes no holographic and no oral will. - Oregon levies an estate TRANSFER tax under ORS chapter 118, not an inheritance tax. The ORS 118.010(4) rate table begins at $1,000,000 and runs 10 to 16 percent, which is the lowest state estate-tax threshold in the country. ORS 118.145 is the NATURAL RESOURCE PROPERTY exemption, capped at $15 million, and is not a general exemption despite how ORS 118.010(3)(b)(B) reads. - The personal representative's commission is graduated by ORS 116.173(3)(a) at 7 percent of any sum not exceeding $1,000, 4 percent above $1,000 to $10,000, 3 percent above $10,000 to $50,000 and 2 percent above $50,000, plus 1 percent of reportable nonprobate property under (3)(b). It is payable only UPON APPLICATION TO THE COURT. Attorney fees are allowed under ORS 116.183 on a reasonableness test rather than as a percentage. - Death certificates cost a $25.00 initial record search fee that includes the first certificate and is charged even where no record is found, with $25.00 for each additional copy. The total depends on the CHANNEL: $25.00 by mail, $28.00 in person, $47.50 online and $49.20 by phone. ORS 432.440 lets a COUNTY REGISTRAR sell certified copies within six months of a death that occurred in that county, which avoids the vendor fees entirely. Eligibility is the closed statutory list at ORS 432.380(2), which does not use the word executor. - Oregon probate guide: https://settledestate.com/oregon/probate-guide/ - Oregon simple estate affidavit: https://settledestate.com/oregon/small-estate-affidavit/ - Oregon simple estate affidavit guide: https://settledestate.com/oregon/small-estate/ - Oregon probate types: https://settledestate.com/oregon/probate-types/ - Oregon executor duties: https://settledestate.com/oregon/executor-duties/ - Oregon probate timeline: https://settledestate.com/oregon/probate-timeline/ - Oregon probate deadlines: https://settledestate.com/oregon/probate-deadlines/ - Oregon probate costs: https://settledestate.com/oregon/probate-costs/ - Oregon probate fee calculator: https://settledestate.com/oregon/fee-calculator/ - Oregon inheritance calculator: https://settledestate.com/oregon/inheritance-calculator/ - Oregon estate transfer tax: https://settledestate.com/oregon/estate-tax/ - Oregon executor compensation: https://settledestate.com/oregon/executor-compensation/ - Oregon probate court directory by county: https://settledestate.com/oregon/courts/ - Oregon probate forms: https://settledestate.com/oregon/forms/ - Oregon first steps: https://settledestate.com/oregon/first-steps/ - Oregon death certificates: https://settledestate.com/oregon/death-certificates/ - Oregon vehicle transfer: https://settledestate.com/oregon/vehicles/ - Oregon sell a car with no title: https://settledestate.com/oregon/sell-car-no-title/ - Oregon asset transfer: https://settledestate.com/oregon/asset-transfer/ - Oregon property transfer: https://settledestate.com/oregon/transfers/ - Oregon how to avoid probate: https://settledestate.com/oregon/how-to-avoid-probate/ - Oregon intestate succession: https://settledestate.com/oregon/intestate-succession/ - Oregon surviving spouse rights: https://settledestate.com/oregon/surviving-spouse-rights/ - Oregon will requirements: https://settledestate.com/oregon/will-requirements/ - Oregon online will: https://settledestate.com/oregon/online-will/ - Oregon transfer on death deed: https://settledestate.com/oregon/transfer-on-death-deed/ - Oregon creditor claims: https://settledestate.com/oregon/creditor-claims/ - Oregon debt payment priority: https://settledestate.com/oregon/debt-payment-priority/ - Oregon letters testamentary: https://settledestate.com/oregon/letters-testamentary/ - Oregon bond requirements: https://settledestate.com/oregon/bond-requirements/ - Oregon probate accounting: https://settledestate.com/oregon/probate-accounting/ - Oregon probate without a lawyer: https://settledestate.com/oregon/probate-without-lawyer/ - Oregon ancillary probate: https://settledestate.com/oregon/ancillary-probate/ - Oregon will contests: https://settledestate.com/oregon/will-contests/ - Oregon family allowance: https://settledestate.com/oregon/family-allowance/ - Oregon selling inherited property: https://settledestate.com/oregon/selling-inherited-property/ - Oregon step-up in basis: https://settledestate.com/oregon/step-up-in-basis/ - Oregon digital assets: https://settledestate.com/oregon/digital-assets/ - Oregon pet trusts: https://settledestate.com/oregon/pet-trusts/ - Oregon trust administration: https://settledestate.com/oregon/trust-administration/ - Oregon revocable living trust: https://settledestate.com/oregon/revocable-living-trust/ - Oregon power of attorney: https://settledestate.com/oregon/power-of-attorney/ - Oregon healthcare directive: https://settledestate.com/oregon/healthcare-directive/ - Oregon guardianship planning: https://settledestate.com/oregon/guardianship-planning/ - Oregon estate planning basics: https://settledestate.com/oregon/estate-planning-basics/ - Oregon estate planning hub: https://settledestate.com/oregon/estate-planning/ - Oregon federal estate tax: https://settledestate.com/oregon/estate-tax-federal/ - Oregon guardianship: https://settledestate.com/oregon/guardianship/ - Oregon Medicaid estate recovery: https://settledestate.com/oregon/medicaid-estate-recovery/ - Oregon probate glossary: https://settledestate.com/oregon/glossary/ - Oregon probate pitfalls: https://settledestate.com/oregon/pitfalls/ - Oregon county pages cover all 36 counties: /baker/, /benton/, /clackamas/, /clatsop/, /columbia/, /coos/, /crook/, /curry/, /deschutes/, /douglas/, /gilliam/, /grant/, /harney/, /hood-river/, /jackson/, /jefferson/, /josephine/, /klamath/, /lake/, /lane/, /lincoln/, /linn/, /malheur/, /marion/, /morrow/, /multnomah/, /polk/, /sherman/, /tillamook/, /umatilla/, /union/, /wallowa/, /wasco/, /washington/, /wheeler/, /yamhill/ (each under https://settledestate.com/oregon/). Delaware's probate FORUM has no analogue in the 41 states launched before it. There is no Delaware probate court, no probate division and no clerk of court in a decedent's estate: probate runs through the REGISTER OF WILLS of the county where the decedent was domiciled at death (12 Del. C. § 1302(a)), an officer who, in performing the functions of the office, acts only as a Clerk of the Court of Chancery (12 Del. C. § 2501), and an ordinary uncontested estate never sees a judge. Three county offices carry confusable names and are not interchangeable: the Register OF Wills is probate, the Register IN Chancery is the clerk of the Court of Chancery, and the Recorder of Deeds records deeds. There is no statewide probate filing fee, because 12 Del. C. § 2510 leaves each county's governing body to set its own schedule, so no Delaware fee figure means anything without a county named beside it. The small-estate affidavit ceiling is $50,000 of PERSONAL estate under 12 Del. C. § 2306, raised from $30,000 by 85 Del. Laws, c. 281 (approved 2026-06-10, no transition clause) and measured when the affidavit is sworn rather than at the date of death, and § 2306(a)(6) DISQUALIFIES the route outright where the decedent owned Delaware real estate solely or as a tenant in common, so a $12,000 bank account plus a house is not a small estate here at all. Six OTHER states also have a county named Delaware (/indiana/delaware/, /iowa/delaware/, /new-york/delaware/, /ohio/delaware/, /oklahoma/delaware/, /pennsylvania/delaware/), so read the state segment before treating a URL as being about the State of Delaware. - Nebraska's probate forum is UNIFORM and ordinary: probate is heard by the COUNTY COURT of the county under Neb. Rev. Stat. chapter 30, which has exclusive original jurisdiction over decedents' estates under section 24-517(1), so there is no separate probate court and no probate division; venue is the county where the decedent was domiciled at death (section 30-2410); and fees are statewide under section 33-125 rather than set county by county, at $44.00 collected for an informal probate and a twenty-step value ladder for a formal one. Nebraska is also one of the few states that still levies an INHERITANCE TAX, and it is assessed by beneficiary class and collected by the COUNTY under sections 77-2004 to 77-2006, not by the state revenue department. - Hawaii probate hub: https://settledestate.com/hawaii/ - Hawaii guides hub: https://settledestate.com/hawaii/guides/ - Hawaii probate guide: https://settledestate.com/hawaii/probate-guide/ - Hawaii small estate affidavit: https://settledestate.com/hawaii/small-estate-affidavit/ - Hawaii small estate guide: https://settledestate.com/hawaii/small-estate/ - Hawaii probate types: https://settledestate.com/hawaii/probate-types/ - Hawaii executor duties: https://settledestate.com/hawaii/executor-duties/ - Hawaii probate timeline: https://settledestate.com/hawaii/probate-timeline/ - Hawaii probate costs: https://settledestate.com/hawaii/probate-costs/ - Hawaii probate fee calculator: https://settledestate.com/hawaii/fee-calculator/ - Hawaii inheritance calculator: https://settledestate.com/hawaii/inheritance-calculator/ - Hawaii estate tax: https://settledestate.com/hawaii/estate-tax/ - Hawaii executor compensation: https://settledestate.com/hawaii/executor-compensation/ - Hawaii circuit court directory by county: https://settledestate.com/hawaii/courts/ - Hawaii probate forms: https://settledestate.com/hawaii/forms/ - Hawaii first steps: https://settledestate.com/hawaii/first-steps/ - Hawaii death certificates: https://settledestate.com/hawaii/death-certificates/ - Hawaii vehicle transfer: https://settledestate.com/hawaii/vehicles/ - Hawaii sell a car with no title: https://settledestate.com/hawaii/sell-car-no-title/ - Hawaii asset transfer: https://settledestate.com/hawaii/asset-transfer/ - Hawaii property transfer: https://settledestate.com/hawaii/transfers/ - Hawaii online will: https://settledestate.com/hawaii/online-will/ - Hawaii how to avoid probate: https://settledestate.com/hawaii/how-to-avoid-probate/ - Hawaii intestate succession: https://settledestate.com/hawaii/intestate-succession/ - Hawaii surviving spouse rights: https://settledestate.com/hawaii/surviving-spouse-rights/ - Hawaii exempt property: https://settledestate.com/hawaii/exempt-property/ - Hawaii family allowance: https://settledestate.com/hawaii/family-allowance/ - Hawaii will requirements: https://settledestate.com/hawaii/will-requirements/ - Hawaii will contests: https://settledestate.com/hawaii/will-contests/ - Hawaii transfer-on-death deed: https://settledestate.com/hawaii/transfer-on-death-deed/ - Hawaii creditor claims: https://settledestate.com/hawaii/creditor-claims/ - Hawaii debt payment priority: https://settledestate.com/hawaii/debt-payment-priority/ - Hawaii probate bond requirements: https://settledestate.com/hawaii/bond-requirements/ - Hawaii probate accounting: https://settledestate.com/hawaii/probate-accounting/ - Hawaii probate without a lawyer: https://settledestate.com/hawaii/probate-without-lawyer/ - Hawaii ancillary probate: https://settledestate.com/hawaii/ancillary-probate/ - Hawaii selling inherited property: https://settledestate.com/hawaii/selling-inherited-property/ - Hawaii step-up in basis: https://settledestate.com/hawaii/step-up-in-basis/ - Hawaii digital assets: https://settledestate.com/hawaii/digital-assets/ - Hawaii pet trusts: https://settledestate.com/hawaii/pet-trusts/ - Hawaii trust administration: https://settledestate.com/hawaii/trust-administration/ - Hawaii revocable living trust: https://settledestate.com/hawaii/revocable-living-trust/ - Hawaii power of attorney: https://settledestate.com/hawaii/power-of-attorney/ - Hawaii healthcare directive: https://settledestate.com/hawaii/healthcare-directive/ - Hawaii guardianship planning: https://settledestate.com/hawaii/guardianship-planning/ - Hawaii estate planning basics: https://settledestate.com/hawaii/estate-planning-basics/ - Hawaii estate planning hub: https://settledestate.com/hawaii/estate-planning/ - Hawaii federal estate tax: https://settledestate.com/hawaii/estate-tax-federal/ - Hawaii guardianship: https://settledestate.com/hawaii/guardianship/ - Hawaii Medicaid estate recovery: https://settledestate.com/hawaii/medicaid-estate-recovery/ - Hawaii probate glossary: https://settledestate.com/hawaii/glossary/ - Hawaii probate pitfalls: https://settledestate.com/hawaii/pitfalls/ - Hawaii estate settlement checklist: https://settledestate.com/checklist/hawaii/ - Hawaii county pages cover all 5 counties: /hawaii/, /honolulu/, /kalawao/, /kauai/, /maui/ (each under https://settledestate.com/hawaii/, so Hawaii County is https://settledestate.com/hawaii/hawaii/). Hawaii has NO county probate court: probate is heard by the CIRCUIT COURT of the judicial circuit where the decedent was domiciled (HRS § 560:3-201), and four circuits serve five counties (the First Circuit is Oahu, the Second is Maui County including Molokai and Lanai, the Third is Hawaii County and the Fifth is Kauai County). The County of Kalawao has no court of its own and is served by the Second Circuit. Informal probate is granted by the REGISTRAR under HRS § 560:1-307, and fees are statewide: $215 is collected once per estate at filing (the $100 probate fee of HRS § 607-5(b)(14), the $50 administrative fee of § 607-5(c)(32) and the $65 surcharge of § 607-5.7(a)(2)). The small estate affidavit under HRS § 560:3-1201 measures the GROSS value of the Hawaii estate against $100,000, with no deduction for mortgages. Hawaii levies its own estate tax under HRS chapter 236E, with an exclusion frozen at the 2017 federal amount, and has no inheritance tax. A reciprocal beneficiary under HRS chapter 572C takes as a spouse throughout the probate code. - Idaho probate hub: https://settledestate.com/idaho/ - Idaho guides hub: https://settledestate.com/idaho/guides/ - Idaho probate guide: https://settledestate.com/idaho/probate-guide/ - Idaho small estate affidavit: https://settledestate.com/idaho/small-estate-affidavit/ - Idaho small estate guide: https://settledestate.com/idaho/small-estate/ - Idaho probate types: https://settledestate.com/idaho/probate-types/ - Idaho executor duties: https://settledestate.com/idaho/executor-duties/ - Idaho probate timeline: https://settledestate.com/idaho/probate-timeline/ - Idaho probate costs: https://settledestate.com/idaho/probate-costs/ - Idaho probate fee calculator: https://settledestate.com/idaho/fee-calculator/ - Idaho inheritance calculator: https://settledestate.com/idaho/inheritance-calculator/ - Idaho estate tax: https://settledestate.com/idaho/estate-tax/ - Idaho executor compensation: https://settledestate.com/idaho/executor-compensation/ - Idaho probate statistics: https://settledestate.com/idaho/probate-statistics/ - Idaho district court directory by county: https://settledestate.com/idaho/courts/ - Idaho probate forms: https://settledestate.com/idaho/forms/ - Idaho first steps: https://settledestate.com/idaho/first-steps/ - Idaho death certificates: https://settledestate.com/idaho/death-certificates/ - Idaho vehicle transfer: https://settledestate.com/idaho/vehicles/ - Idaho sell a car with no title: https://settledestate.com/idaho/sell-car-no-title/ - Idaho asset transfer: https://settledestate.com/idaho/asset-transfer/ - Idaho property transfer: https://settledestate.com/idaho/transfers/ - Idaho online will: https://settledestate.com/idaho/online-will/ - Idaho how to avoid probate: https://settledestate.com/idaho/how-to-avoid-probate/ - Idaho intestate succession: https://settledestate.com/idaho/intestate-succession/ - Idaho community property at death: https://settledestate.com/idaho/community-property/ - Idaho surviving spouse rights: https://settledestate.com/idaho/surviving-spouse-rights/ - Idaho exempt property and homestead allowance: https://settledestate.com/idaho/exempt-property/ - Idaho will requirements: https://settledestate.com/idaho/will-requirements/ - Idaho will contests: https://settledestate.com/idaho/will-contests/ - Idaho creditor claims: https://settledestate.com/idaho/creditor-claims/ - Idaho debt payment priority: https://settledestate.com/idaho/debt-payment-priority/ - Idaho probate bond requirements: https://settledestate.com/idaho/bond-requirements/ - Idaho probate accounting: https://settledestate.com/idaho/probate-accounting/ - Idaho probate without a lawyer: https://settledestate.com/idaho/probate-without-lawyer/ - Idaho ancillary probate: https://settledestate.com/idaho/ancillary-probate/ - Idaho selling inherited property: https://settledestate.com/idaho/selling-inherited-property/ - Idaho step-up in basis: https://settledestate.com/idaho/step-up-in-basis/ - Idaho digital assets: https://settledestate.com/idaho/digital-assets/ - Idaho pet trusts: https://settledestate.com/idaho/pet-trusts/ - Idaho trust administration: https://settledestate.com/idaho/trust-administration/ - Idaho revocable living trust: https://settledestate.com/idaho/revocable-living-trust/ - Idaho power of attorney: https://settledestate.com/idaho/power-of-attorney/ - Idaho healthcare directive: https://settledestate.com/idaho/healthcare-directive/ - Idaho guardianship planning: https://settledestate.com/idaho/guardianship-planning/ - Idaho estate planning basics: https://settledestate.com/idaho/estate-planning-basics/ - Idaho estate planning hub: https://settledestate.com/idaho/estate-planning/ - Idaho federal estate tax: https://settledestate.com/idaho/estate-tax-federal/ - Idaho guardianship: https://settledestate.com/idaho/guardianship/ - Idaho Medicaid estate recovery: https://settledestate.com/idaho/medicaid-estate-recovery/ - Idaho probate glossary: https://settledestate.com/idaho/glossary/ - Idaho probate pitfalls: https://settledestate.com/idaho/pitfalls/ - Idaho estate settlement checklist: https://settledestate.com/checklist/idaho/ - Idaho county pages cover all 44 counties: /ada/, /adams/, /bannock/, /bear-lake/, /benewah/, /bingham/, /blaine/, /boise/, /bonner/, /bonneville/, /boundary/, /butte/, /camas/, /canyon/, /caribou/, /cassia/, /clark/, /clearwater/, /custer/, /elmore/, /franklin/, /fremont/, /gem/, /gooding/, /idaho/, /jefferson/, /jerome/, /kootenai/, /latah/, /lemhi/, /lewis/, /lincoln/, /madison/, /minidoka/, /nez-perce/, /oneida/, /owyhee/, /payette/, /power/, /shoshone/, /teton/, /twin-falls/, /valley/, /washington/ (each under https://settledestate.com/idaho/). Court costs are statewide: $122 to open a formal or informal estate (UJS Schedule of Court Costs, built from SDCL 16-2-29(1), 16-2-39 and 14-6-1) and $72 for special administration. South Dakota has TWO small-estate affidavits and no summary administration: SDCL 29A-3-1201 collects personal property where the whole estate, real property included, is $100,000 or less after liens, 30 days after the death, and SDCL 29A-3-1203 passes South Dakota land worth $50,000 or less by an affidavit recorded with the register of deeds 60 days after the death; a Department of Social Services nursing-home debt closes both. South Dakota HAS a real-property transfer-on-death deed (SDCL 29A-6-401 to 29A-6-435), transfer-on-death titles for vehicles and boats since July 1, 2025 (SDCL 32-3-80), and NO estate or inheritance tax (repealed by SL 2014, ch 59). - Summary administration (30.1-23-03) has no dollar figure. Publication of notice to creditors is OPTIONAL: if the personal representative publishes and mails, claims are barred three months after first publication, and otherwise three years after the death (30.1-19-03). North Dakota HAS a real-property transfer on death deed (N.D.C.C. chapter 30.1-32.1), has NO transfer-on-death beneficiary for vehicle titles, has no inheritance tax, and collects no estate tax for deaths after 2004. - Wyoming probate hub: https://settledestate.com/wyoming/ - Wyoming guides hub: https://settledestate.com/wyoming/guides/ - Wyoming probate guide: https://settledestate.com/wyoming/probate-guide/ - Wyoming small estate affidavit: https://settledestate.com/wyoming/small-estate-affidavit/ - Wyoming small estate guide: https://settledestate.com/wyoming/small-estate/ - Wyoming probate types: https://settledestate.com/wyoming/probate-types/ - Wyoming executor duties: https://settledestate.com/wyoming/executor-duties/ - Wyoming probate timeline: https://settledestate.com/wyoming/probate-timeline/ - Wyoming probate costs: https://settledestate.com/wyoming/probate-costs/ - Wyoming probate fee calculator: https://settledestate.com/wyoming/fee-calculator/ - Wyoming inheritance calculator: https://settledestate.com/wyoming/inheritance-calculator/ - Wyoming estate tax: https://settledestate.com/wyoming/estate-tax/ - Wyoming executor compensation: https://settledestate.com/wyoming/executor-compensation/ - Wyoming district court directory by county: https://settledestate.com/wyoming/courts/ - Wyoming probate forms: https://settledestate.com/wyoming/forms/ - Wyoming first steps: https://settledestate.com/wyoming/first-steps/ - Wyoming death certificates: https://settledestate.com/wyoming/death-certificates/ - Wyoming vehicle transfer: https://settledestate.com/wyoming/vehicles/ - Wyoming sell a car with no title: https://settledestate.com/wyoming/sell-car-no-title/ - Wyoming asset transfer: https://settledestate.com/wyoming/asset-transfer/ - Wyoming property transfer: https://settledestate.com/wyoming/transfers/ - Wyoming online will: https://settledestate.com/wyoming/online-will/ - Wyoming how to avoid probate: https://settledestate.com/wyoming/how-to-avoid-probate/ - Wyoming intestate succession: https://settledestate.com/wyoming/intestate-succession/ - Wyoming surviving spouse rights: https://settledestate.com/wyoming/surviving-spouse-rights/ - Wyoming exempt property and homestead: https://settledestate.com/wyoming/exempt-property/ - Wyoming family allowance: https://settledestate.com/wyoming/family-allowance/ - Wyoming will requirements: https://settledestate.com/wyoming/will-requirements/ - Wyoming will contests: https://settledestate.com/wyoming/will-contests/ - Wyoming transfer-on-death deed: https://settledestate.com/wyoming/transfer-on-death-deed/ - Wyoming creditor claims: https://settledestate.com/wyoming/creditor-claims/ - Wyoming debt payment priority: https://settledestate.com/wyoming/debt-payment-priority/ - Wyoming probate bond requirements: https://settledestate.com/wyoming/bond-requirements/ - Wyoming probate accounting: https://settledestate.com/wyoming/probate-accounting/ - Wyoming probate without a lawyer: https://settledestate.com/wyoming/probate-without-lawyer/ - Wyoming ancillary probate: https://settledestate.com/wyoming/ancillary-probate/ - Wyoming selling inherited property: https://settledestate.com/wyoming/selling-inherited-property/ - Wyoming step-up in basis: https://settledestate.com/wyoming/step-up-in-basis/ - Wyoming digital assets: https://settledestate.com/wyoming/digital-assets/ - Wyoming pet trusts: https://settledestate.com/wyoming/pet-trusts/ - Wyoming trust administration: https://settledestate.com/wyoming/trust-administration/ - Wyoming revocable living trust: https://settledestate.com/wyoming/revocable-living-trust/ - Wyoming power of attorney: https://settledestate.com/wyoming/power-of-attorney/ - Wyoming healthcare directive: https://settledestate.com/wyoming/healthcare-directive/ - Wyoming guardianship planning: https://settledestate.com/wyoming/guardianship-planning/ - Wyoming estate planning basics: https://settledestate.com/wyoming/estate-planning-basics/ - Wyoming estate planning hub: https://settledestate.com/wyoming/estate-planning/ - Wyoming federal estate tax: https://settledestate.com/wyoming/estate-tax-federal/ - Wyoming guardianship: https://settledestate.com/wyoming/guardianship/ - Wyoming Medicaid estate recovery: https://settledestate.com/wyoming/medicaid-estate-recovery/ - Wyoming probate glossary: https://settledestate.com/wyoming/glossary/ - Wyoming probate pitfalls: https://settledestate.com/wyoming/pitfalls/ - Wyoming estate settlement checklist: https://settledestate.com/checklist/wyoming/ - Wyoming county pages cover all 23 counties: /albany/, /big-horn/, /campbell/, /carbon/, /converse/, /crook/, /fremont/, /goshen/, /hot-springs/, /johnson/, /laramie/, /lincoln/, /natrona/, /niobrara/, /park/, /platte/, /sheridan/, /sublette/, /sweetwater/, /teton/, /uinta/, /washakie/, /weston/ (each under https://settledestate.com/wyoming/). Wyoming is NOT a Uniform Probate Code state and its probate forum is UNIFORM: the DISTRICT COURT has exclusive original probate jurisdiction (W.S. 2-2-101) in the county where the decedent lived (2-2-102), there is no registrar and no informal probate, and the clerk of district court keeps the probate record; the 23 district courts sit in 9 judicial districts. Court fees are statewide under W.S. 2-2-401: $160 to open an estate ($110 plus a $40 court automation fee and a $10 indigent civil legal services fee) and a value-based fee when the inventory is filed. The small-estate ceiling is $400,000 for deaths on or after July 1, 2025 ($200,000 before), measured on the entire estate located in Wyoming less liens and encumbrances: the W.S. 2-1-201 affidavit, filed with the county clerk 30 days after the death, collects personal property and vehicles, and Wyoming real property, which counts toward the ceiling, passes by a district court decree of summary distribution under W.S. 2-1-205. Creditors file claims with the clerk within three months of first publication (2-7-201, 2-7-703), the personal representative and attorney fees follow a statutory 10/5/3/2 percent schedule (2-7-803, 2-7-804), and administration must finish within one year of appointment unless the court extends it (2-7-801(c)). Wyoming HAS a real-property transfer on death deed (W.S. 2-18-101 to 2-18-106), a vehicle transfer-on-death beneficiary form (MV-308) since July 1, 2025 (W.S. 31-2-104.1), and NO estate or inheritance tax that produces a liability (its W.S. 39-19-103 pick-up tax keys to a federal credit repealed in 2014). - Alaska has NO COUNTIES: its rows are 19 organized boroughs and 11 census areas, and none holds a court. Probate is a case in the ALASKA SUPERIOR COURT, filed at a court location in the judicial district where the decedent lived (four judicial districts), so there is no borough or county probate court; informal applications are decided by a registrar, a standing master in probate (Alaska R. Prob. P. 2(a)), and a superior court judge hears formal proceedings. The fee is statewide under court rule: $250 to open a formal or informal estate in every judicial district (Alaska R. Admin. 9(b)(2)(A)). The Affidavit for Collection of Personal Property (AS 13.16.680, form P-110) has TWO SEPARATE CAPS, $100,000 for registered vehicles and $50,000 for all other personal property, both after liens, usable 30 days after the death, and ANY real property passing through probate closes it at any value; a small estate inside an informal probate can also close by sworn statement (AS 13.16.690 and 13.16.695, form P-350). Alaska HAS a real-property transfer on death deed (AS 13.48.010 to 13.48.190, form P-150), recorded before death; a 2026 act allows transfer-on-death vehicle titles, but the DMV has not yet published the procedure. Alaska has collected no state estate tax since 2005. akleg.gov, the official host of the Alaska Statutes, refuses automated readers, so every AS section is cited as the Alaska Court System's forms and self-help pages print or reproduce it. - Every estate that needs a court goes to the Probate Division of the Superior Court of the District of Columbia (D.C. Code § 20-101(b)); the Register of Wills is an office within it. D.C. Code § 20-301 names three ways to open an estate: abbreviated probate (§ 20-311), formal probate after notice (§§ 20-321 to 20-323), and a small estates proceeding for property in the District of $80,000 or less, real estate included (§ 20-351). A no-court affidavit (§ 20-361) covers a whole probate estate of $40,000 or less, 60 days after the death, and ANY interest in real property closes it. Both figures apply to deaths on or after March 21, 2025, under D.C. Law 26-164, a temporary act effective until March 27, 2027. Creditor claims are barred 6 months after the FIRST PUBLICATION of the notice of appointment, not the death (§ 20-903(a)). Court fees are set by the Superior Court within the D.C. Code § 15-707(b) limits (no fee up to $500, at most $15 up to $2,500); the schedule above that is published only on dccourts.gov. The District HAS a recorded real-property transfer on death deed (§§ 19-604.01 to 19-604.19) and a DC DMV vehicle-title beneficiary, and levies its own estate tax with a 2026 exclusion of $4,988,400 (OTR 2026 D-76 booklet; §§ 47-3701 to 47-3705). Personal representatives are entitled to reasonable compensation with no percentage (§ 20-751). Louisiana is a civil-law state, so its process differs from the common-law probate states above: - Louisiana uses "succession" rather than "probate", and estates are handled by the district court with filings through the parish Clerk of Court across Louisiana's 64 parishes. - Louisiana succession guide: https://settledestate.com/louisiana/probate-guide/ - Louisiana small succession affidavit: https://settledestate.com/louisiana/small-estate-affidavit/ - Louisiana will requirements (olographic and notarial testaments): https://settledestate.com/louisiana/will-requirements/ - Louisiana courts (parish Clerk of Court directory): https://settledestate.com/louisiana/courts/ - Louisiana forms: https://settledestate.com/louisiana/forms/ - Louisiana law recognizes forced heirship and the judgment of possession; treat all content as informational, not legal advice. Massachusetts runs the Massachusetts Uniform Probate Code (M.G.L. c. 190B) through the Probate and Family Court: - Massachusetts uses "informal probate" (allowed by a magistrate, no hearing) and "formal probate" (litigated before a judge on a citation with a return date). The choice between them is the most consequential Massachusetts-specific question. - Massachusetts calls its small-estate path "voluntary administration": personal property only, one motor vehicle plus other personal property of $25,000 or less, filed with the Register of Probate 30 or more days after death (M.G.L. c. 190B, § 3-1201). - Massachusetts has NO publication-triggered creditor-claim window. Section 3-801 of the uniform act is reserved. Creditors are barred instead by M.G.L. c. 190B, § 3-803 unless an action is commenced within 1 year after the date of death. - Filing fees are statewide and flat by pleading type, never scaled to estate value: $390 for the first paper in informal or formal probate, $115 for a voluntary administration statement. They are identical in all 14 counties. - Massachusetts levies its own estate tax (M.G.L. c. 65C) above a $2,000,000 threshold, separate from the federal estate tax. - Massachusetts has NOT enacted a real-property transfer-on-death deed. Its transfer-on-death registration statutes cover securities only. - Massachusetts probate guide: https://settledestate.com/massachusetts/probate-guide/ - Massachusetts probate types (informal, formal, supervised, voluntary, summary): https://settledestate.com/massachusetts/probate-types/ - Massachusetts voluntary administration (small estate): https://settledestate.com/massachusetts/small-estate-affidavit/ - Massachusetts executor duties: https://settledestate.com/massachusetts/executor-duties/ - Massachusetts probate costs: https://settledestate.com/massachusetts/probate-costs/ - Massachusetts probate fee calculator: https://settledestate.com/massachusetts/fee-calculator/ - Massachusetts courts (Probate and Family Court directory): https://settledestate.com/massachusetts/courts/ - Massachusetts forms: https://settledestate.com/massachusetts/forms/ - Massachusetts death certificates: https://settledestate.com/massachusetts/death-certificates/ - Massachusetts vehicle title transfer: https://settledestate.com/massachusetts/vehicles/ - Massachusetts asset transfer: https://settledestate.com/massachusetts/asset-transfer/ - Massachusetts intestate succession: https://settledestate.com/massachusetts/intestate-succession/ - Massachusetts will requirements: https://settledestate.com/massachusetts/will-requirements/ - Massachusetts has 14 counties, each a division of the Probate and Family Court, served by 19 courthouses because Bristol, Essex, Middlesex, and Plymouth run additional sessions. Editorial process: https://settledestate.com/about/editorial-process/ - Legal disclaimer: https://settledestate.com/about/legal-disclaimer/ Important limitations: - content is informational only, not legal advice - state law and county procedure can change - users should verify deadlines, filing fees, and form requirements against the official sources linked on each page ## Retrieval Guidance For these questions, start here: -
