Note: Kansas probate filing fees are STATEWIDE STATUTORY AMOUNTS, not county-set. K.S.A. 59-104(a)(1) fixes the docket fee for "Probate of an estate or of a will" at $109.50, and (a)(2) provides that the docket fee is the only fee collected, that it may be established only by an act of the legislature, and that no other authority exists to collect one. The same table sets $49.50 for a determination of descent, $48.50 for a refusal to grant letters, for filing a will and affidavit under K.S.A. 59-618a, for terminating a joint tenancy and for terminating a life estate, $69.50 each for guardianship, conservatorship, trusteeship and a combined guardianship and conservatorship, $23.50 for certified probate proceedings under K.S.A. 59-213, and $173.00 for decrees in probate from another state. CURRENCY: the revisor's published text of (a)(2) still describes the supreme court's additional non-judicial-personnel charge as running "On and after July 1, 2019, through June 30, 2025", an authority that lapsed on 2025-06-30. 2026 ch. 35 (HB 2393), approved April 3, 2026, moves that window to July 1, 2026 through June 30, 2030 and leaves the base table unchanged, so a clerk may add up to $22 to any docket fee. WHETHER the supreme court has actually imposed that charge, and at what amount, is published only on the Kansas judicial branch website, a host that disallows automated collection, so it is NOT recorded here as a number: ask the clerk what the counter total is. No general per-page certified-copy charge is asserted either, because K.S.A. 28-170(a)(3) prices a district court clerk's copy and certification as "such fee as shall be prescribed by the district court", which is per-district and unpublished to us. Publication of the notice to creditors is a separate cost paid to a newspaper. Where the total assets of the estate do not exceed $10,000 the court may remit court costs or part of them (K.S.A. 59-2215), and a poverty affidavit may be filed in lieu of the docket fee (K.S.A. 59-104(b)).

  • Original Will

    A petition to probate it must be filed within six months of the death or the will does not pass property (K.S.A. 59-617).

  • Petition for Probate of Will or for Administration

    Filed with the clerk of the district court in the county of the decedent's residence.

  • Notice of the Right to Elect, Mailed to the Surviving Spouse

    Due within 10 days of qualification, of the filing of a petition for refusal of letters, or of the filing of a K.S.A. 59-618a affidavit. Proof is by affidavit filed with the court.

  • Inventory and Valuation

    Due within 30 days of the letters of appointment.

  • Small Estates Affidavit (02-2024)

    The Kansas Judicial Council form for the K.S.A. 59-1507b route. Given to the holder of the property, not filed with the court. Its revision date lines up with L. 2024, ch. 35, the act that restructured the section.
