Note: Kansas probate filing fees are flat statewide docket fees set by K.S.A. 59-104(a)(1) and are identical in all 105 counties. There is no Kansas probate tax and no fee that varies with the size of the estate, and Labette County sets none of these amounts. The table, re-read at the revisor on 2026-09-07, charges $109.50 to probate an estate or a will, $49.50 for a determination of descent under K.S.A. 59-2250, $48.50 for a refusal to grant letters of administration, $48.50 for filing a will and affidavit under K.S.A. 59-618a, $48.50 each for termination of joint tenancy and termination of life estate, $69.50 each for guardianship, conservatorship, trusteeship and a combined guardianship and conservatorship, $23.50 for certified probate proceedings under K.S.A. 59-213, and $173.00 for decrees in probate from another state. K.S.A. 59-104(a)(2) says the docket fee is the only fee collected for the docket fee and may be established only by an act of the legislature, and it separately lets the supreme court charge up to $22 more per docket fee for non-judicial personnel; that authority now runs July 1, 2026 through June 30, 2030 under 2026 Kansas Session Laws chapter 35. Whether the supreme court has imposed the surcharge, and at what amount, is published only on the Kansas Judicial Branch site and was NOT collected, so the figures here are statutory minimums rather than the total taken at the counter. The clerk's charge for a copy or a certification is not a statewide figure at all: K.S.A. 28-170(a)(3) prices it as such fee as shall be prescribed by the district court, so it is left null rather than guessed. K.S.A. 59-104(d) taxes other fees and expenses as additional court costs approved by the court unless fixed by statute, expressly including appraiser fees, publication of legal notice, executor or administrator fees and attorney fees. The K.S.A. 59-1507b small estates affidavit is given to the holder of the property and is never filed with a court, so it carries no docket fee; that zero is recorded on the route itself rather than as a bare fees entry, because a report builder would otherwise apply it to a court route that really costs $109.50.

    Due within 10 days of qualification, of the filing of a petition for refusal of letters, or of the filing of a K.S.A. 59-618a affidavit. Proof is by affidavit filed with the court.

  • Inventory and Valuation

    Due within 30 days of the letters of appointment.

  • Small Estates Affidavit (02-2024)

    The Kansas Judicial Council form for the K.S.A. 59-1507b route. Given to the holder of the property, not filed with the court. Its revision date lines up with L. 2024, ch. 35, the act that restructured the section.
