Note: Kansas probate filing fees are flat statewide docket fees set by K.S.A. 59-104(a)(1), identical in all 105 counties. There is no Kansas probate tax and no fee that varies with the size of the estate. The table charges $109.50 to probate an estate or a will, $49.50 for a determination of descent under K.S.A. 59-2250, $48.50 for a refusal to grant letters of administration, $48.50 for filing a will and affidavit under K.S.A. 59-618a, $48.50 each for termination of joint tenancy and termination of life estate, $69.50 each for guardianship, conservatorship and trusteeship, $23.50 for certified probate proceedings under K.S.A. 59-213, and $173.00 for decrees in probate from another state. K.S.A. 59-104(a)(2) says the docket fee is the only fee collected for the docket fee and may be established only by legislative enactment, and it separately authorizes the supreme court to charge up to $22 more per docket fee for non-judicial personnel. That surcharge authority was reset to the window running July 1, 2026 through June 30, 2030 by 2026 Kansas Session Laws chapter 35, approved April 3, 2026, which left the base table unchanged. Whether the supreme court has imposed the surcharge, and at what amount, is published only on the Kansas Judicial Branch site and was NOT collected, so the amounts here are the statutory minimums rather than the total collected at the counter. The clerk's charge for a copy or a certification is not a statewide figure at all: K.S.A. 28-170(a)(3) prices it as such fee as shall be prescribed by the district court, so it is recorded as null rather than guessed. K.S.A. 59-104(b) lets a party who cannot afford the docket fee file a poverty affidavit instead, and K.S.A. 59-2215 lets the court remit court costs where the total assets of the estate do not exceed $10,000. The K.S.A. 59-1507b small estates affidavit is never filed with a court, so it carries no filing fee.
