Note: Kansas has NO probate tax and NO value-based probate filing fee, and no county fee schedule: K.S.A. 59-104(a)(2) says a docket fee may be established only by an act of the legislature and that no other fees or charges are authorized. K.S.A. 59-104(d) taxes other fees and expenses as additional court costs approved by the court unless fixed by statute, expressly including appraiser fees, publication of legal notice, executor or administrator fees and attorney fees. K.S.A. 59-2214 requires the court to tax probate costs against the estate unless that would be unjust and inequitable. The K.S.A. 59-1507b small estates affidavit is given to the holder of the property and never filed with the court, so it carries no docket fee. No general per-page certified-copy charge for a Kansas district court clerk is asserted here: that schedule is published on a host this project may not collect from, so ask the clerk.

- Original Will
A petition to probate it must be filed within six months of the death or the will does not pass property (K.S.A. 59-617).
- Petition for Probate of Will or for Administration
Filed with the clerk of the district court in the county of the decedent's residence.
- Notice of the Right to Elect, Mailed to the Surviving Spouse
Due within 10 days of qualification, of the filing of a petition for refusal of letters, or of the filing of a K.S.A. 59-618a affidavit. Proof is by affidavit filed with the court.
