Note: Kansas has NO probate tax and NO value-based probate filing fee. Every amount here is the statewide statutory docket fee set by K.S.A. 59-104, whose subsection (a)(2) says the fee may be established only by an act of the legislature and that no other authority exists to charge one, so these figures are identical in all 105 counties and Seward County sets none of its own. The whole (a)(1) table was read at the revisor on 2026-09-07 and every figure above matches it line for line. K.S.A. 59-104(d) taxes other fees and expenses as additional court costs approved by the court unless fixed by statute, expressly including appraiser fees, publication of legal notice, executor or administrator fees and attorney fees. The K.S.A. 59-1507b small estates affidavit is given to the holder of the property and is never filed with the court, so it carries no docket fee; that $0 is recorded on the route itself (types_of_probate.small_estate_affidavit.filing_fee) rather than as a bare fees.small_estate_affidavit, because the report builder would then apply it to the simplified-estate route as well and a simplified estate pays the full $109.50. No per-page certified-copy charge for a Kansas district court clerk is asserted here: that schedule is published only on a host this project may not collect from, so ask the clerk of the district court.

A petition to probate it must be filed within six months of the death or the will does not pass property (K.S.A. 59-617).
- Petition for Probate of Will or for Administration
Filed with the clerk of the district court in the county of the decedent's residence.
- Notice of the Right to Elect, Mailed to the Surviving Spouse
Due within 10 days of qualification, of the filing of a petition for refusal of letters, or of the filing of a K.S.A. 59-618a affidavit. Proof is by affidavit filed with the court.
