Probate Filing Fees

Maine sets probate filing fees by a single STATEWIDE statutory schedule (18-C M.R.S. § 1-602), graduated by the value of the estate and identical in all 16 county probate courts (there is no county-by-county variation, and the same scale applies to both informal and formal probate). Value brackets, fixed under Title 18-C (2019, as amended by PL 2021 c. 250): $10,000 or less = $40; $10,001-$20,000 = $60; $20,001-$30,000 = $75; $30,001-$40,000 = $95; $40,001-$50,000 = $125; $50,001-$75,000 = $190; $75,001-$100,000 = $250; $100,001-$150,000 = $325; $150,001-$200,000 = $375; $200,001-$250,000 = $450; $250,001-$300,000 = $500; $300,001-$400,000 = $575; $400,001-$500,000 = $625; $500,001-$750,000 = $700; $750,001-$1,000,000 = $750; $1,000,001-$1,500,000 = $875; $1,500,001-$2,000,000 = $950; more than $2,000,000 = $1,200 base, then $250 for each additional $500,000 (or part) of value above $2,500,000. These filing fees are fixed and are NOT inflation-adjusted. Other flat § 1-602 fees: a will filed for safekeeping without probate is $15; a will probated without appointment is $20; a single certificate of appointment is $10 ($20 double); record copies are $1 per page (some counties charge $2 at the counter). The small-estate affidavit under § 3-1201 is presented to the asset holder and carries no court filing fee. A separate e-filing surcharge (about $7) may apply.
