Probate Filing Fees

Specific fee amounts are not available for this county. Maryland charges no separate per-county probate filing fee. The Register of Wills collects one statewide, value-based probate fee set by statute (Md. Code, Est. & Trusts 2-206) on the value of the probate estate: $0 for an estate under $50,000; $100 for $50,000 to under $100,000; $200 for $100,000 to under $500,000; $1,000 for $500,000 to under $1,000,000; $2,000 for $1,000,000 to under $2,500,000; $5,000 for $2,500,000 to under $5,000,000; $7,500 for $5,000,000 to under $7,500,000; $10,000 for $7,500,000 to under $10,000,000; and $10,000 plus 0.02% of the excess for estates of $10,000,000 and over. The register assesses the fee when the first administration account (or, in a modified administration, the final report) is filed, and assesses more if a later account shows a higher estate value. A poverty-based fee waiver exists under 2-206(a). This same statewide schedule applies in all 24 Maryland jurisdictions. Personal representative commissions are separate (up to 9% of the first $20,000 of estate value plus 3.6% of the excess, Md. Code, Est. & Trusts 7-601). Source: Md.     The original signed will and any codicils, filed with the Register of Wills.
