Note: Montana has NO probate tax and NO per-county or value-based filing fee. The clerks' schedule charges $100 to commence a probate, formal or informal: $70 under § 25-1-201(1)(m) (which includes filing a will for probate), $20 under § 25-1-202(1)(a), and $10 under § 3-1-317(1)(b), which applies to "probate cases" by name. Publish $100, never the $70 base. The Mont. Code Ann. 72-3-1101 affidavit for collection of personal property is never filed with a court, so small_estate_affidavit is 0. The same fees apply in every Montana county; confirm the amount with the clerk before filing.
