Note: UTAH SETS COURT FEES STATEWIDE AND DAGGETT COUNTY CHARGES NO FEE OF ITS OWN. Filing a petition to open a probate costs $375 under Utah Code Section 78A-2-301(1)(a), the fee for any civil complaint or petition invoking the jurisdiction of a court of record not governed by another subsection; a probate petition is not governed by another subsection, so that is the figure. The Utah State Courts fee schedule effective May 6, 2026 prints the same $375 against Subsection (1)(a). There are no per-county filing fees in Utah and no bands by estate value for opening an estate. DO NOT CONFUSE THE ACCOUNTING LADDER WITH THE FILING FEE: Section 78A-2-301(1)(r) is headed "The fee for filing any accounting required by law is" and charges $15, $30, $50, $90 or $175 by the value of the estate. That is the fee to file an ACCOUNTING, which arises in supervised administration and in conservatorships, and quoting its bottom band would publish a $15 probate filing fee. BOTH SMALL-ESTATE ROUTES COST NOTHING, and that is a statutory conclusion rather than a gap in the research. A Section 75-3-1201 affidavit is never filed with a court at all, so there is no clerk and no fee. The Section 75-3-1203 summary administrative procedure is a way of CLOSING an estate cheaply, not of opening one: a personal representative is already appointed and the $375 has already been paid. Section 78A-2-301(2) closes the question by saying there is no fee for a service or the filing of documents not listed in the section. Filing probate documents FROM ANOTHER STATE costs $35 under Subsection (1)(m); that is stored here as ancillary_administration and it is not the fee to open a Utah probate. A certified copy is $4 per document plus 50 cents per page (Subsection (1)(z)) and an exemplified copy is $6 per document plus 50 cents per page (Subsection (1)(aa)). A fee waiver is available to an indigent litigant on affidavit under Section 78A-2-302. PENDING VERSION: Section 78A-2-301 carries an end date of January 1, 2027 and a successor enacted by Chapter 378, 2026 General Session is already published. The two were compared on 2026-08-28: the $375 and the whole accounting ladder survive the change. Re-read before the next Utah fee edit.
