Note: Utah court fees are set STATEWIDE by Utah Code § 78A-2-301; there is no probate tax and no per-county probate filing fee anywhere in Utah. Section 78A-2-301(2) provides that there is no fee for a service or the filing of a document not listed in that section or otherwise provided by law, which is the statutory basis for every negative fee statement here. An application or petition to open a decedent's estate is a civil petition invoking the jurisdiction of a court of record not governed by another subsection, so it takes the § 78A-2-301(1)(a) fee of $375 (version effective 5/6/2026, superseded 1/1/2027). Filing probate documents from another state is $35 under § 78A-2-301(1)(m). A certified copy is $4 per document plus $0.50 per page (§ 78A-2-301(1)(z)); an exemplified copy is $6 per document plus $0.50 per page (§ 78A-2-301(1)(aa)). A small estate affidavit under § 75-3-1201 costs $0 because it is never filed with a court, and the § 75-3-1203 summary administrative procedure adds no fee because the $375 was already paid to open the estate. THE ESTATE-VALUE LADDER IN § 78A-2-301(1)(r) IS NOT THE FILING FEE: its verbatim lead-in is "The fee for filing any accounting required by law is", and it runs $15 / $30 / $50 / $90 / $175 by estate value. Publishing it as a probate filing fee would advertise a $15 Utah probate. Every figure was read in the versioned statute text and cross-read against the Utah State Courts fee schedule, table headed "Filing Fees - Effective May 6, 2026". Verify current amounts with the court before filing.

Ongoing Estate Fees

Required Documents

  • Certified Death Certificate

    Order several certified copies from the Utah Office of Vital Records and Statistics, online, in person at a local health department for same-day service, or by mail. $35.00 for the initial certified copy and $10.00 for each additional copy of the same record ordered the same day (fee schedule effective July 1, 2026). Not a court form.

  • Original Will

    The custodian must deliver the original will with reasonable promptness, on the request of an interested person, to a person able to secure its probate (Utah Code § 75-2-902). Required only where the decedent left a will.

  • Application for Informal Probate and/or Informal Appointment of Personal Representative

    Filed with the district court in the county of the decedent's domicile. The clerk then mails notice to heirs and devisees and the registrar acts after 10 days from that notice.

  • Letters Testamentary or Letters of Administration

    Issued by the registrar on appointment; they prove the personal representative's authority.

  • Notice to Creditors

    Optional in Utah. Publishing once a week for three successive weeks in a county newspaper and for three weeks on the Utah Public Notice Website starts the three-month claim bar (Utah Code § 75-3-801).

  • Inventory and Appraisement

    Prepared within three months after appointment; sent to interested persons who request it, and optionally filed with the court (Utah Code § 75-3-705).

  • Small Estate Affidavit

    Not filed with the court. The successor completes it, signs before a notary, and presents it to the bank or other holder of the property. Utah publishes no court form number for it.

  • TC-569C Survivorship Affidavit (vehicles)(TC-569C)

    Presented to the Division of Motor Vehicles to retitle up to four boats, motor vehicles, trailers or semitrailers. The DMV also requires that there be no active lienholder on the vehicle.
