Note: Utah court fees are set STATEWIDE by Utah Code § 78A-2-301 and there is no per-county filing fee and no probate tax in Summit County. A petition to open a decedent's estate, informal or formal, is a petition invoking the jurisdiction of a court of record not governed by another subsection, so it takes the 78A-2-301(1)(a) fee of $375. Filing a probate document of another state costs $35 under (1)(m). A certified copy costs $4.00 per document plus $0.50 a page under (1)(z) and an exemplified copy $6.00 plus $0.50 a page under (1)(aa). Both Utah small-estate routes cost nothing, by two different mechanisms: the Utah Code § 75-3-1201 affidavit is never filed with a court at all, and the Utah Code § 75-3-1203 summary administrative procedure is a way of CLOSING an estate for which the $375 has already been paid, not a way of opening one. Utah Code § 78A-2-301(2) is the statutory basis for every negative fee claim here: "There is no fee for services or the filing of documents not listed in this section or otherwise provided by law." Fee waivers for an indigent litigant are available on affidavit under Utah Code § 78A-2-302. The section carries an end date of January 1, 2027, so re-read it before relying on a figure after that date.

Required Documents

Certified Death Certificate
Order several certified copies from the Utah Office of Vital Records and Statistics, online, in person at a local health department for same-day service, or by mail. $35.00 for the initial certified copy and $10.00 for each additional copy of the same record ordered the same day (fee schedule effective July 1, 2026). Not a court form.
Original Will
The custodian must deliver the original will with reasonable promptness, on the request of an interested person, to a person able to secure its probate (Utah Code § 75-2-902). Required only where the decedent left a will.
Application for Informal Probate and/or Informal Appointment of Personal Representative
Filed with the district court in the county of the decedent's domicile. The clerk then mails notice to heirs and devisees and the registrar acts after 10 days from that notice.
Letters Testamentary or Letters of Administration
Issued by the registrar on appointment; they prove the personal representative's authority.
Notice to Creditors
Optional in Utah. Publishing once a week for three successive weeks in a county newspaper and for three weeks on the Utah Public Notice Website starts the three-month claim bar (Utah Code § 75-3-801).
Inventory and Appraisement
Prepared within three months after appointment; sent to interested persons who request it, and optionally filed with the court (Utah Code § 75-3-705).
Small Estate Affidavit
Not filed with the court. The successor completes it, signs before a notary, and presents it to the bank or other holder of the property. Utah publishes no court form number for it.
TC-569C Survivorship Affidavit (vehicles)(TC-569C)
Presented to the Division of Motor Vehicles to retitle up to four boats, motor vehicles, trailers or semitrailers. The DMV also requires that there be no active lienholder on the vehicle.
