Note: Utah sets court fees statewide by Utah Code 78A-2-301 and there is no per-county probate filing fee and no probate tax. A petition to open a decedent's estate is a civil petition invoking the jurisdiction of a court of record that no other subsection governs, so it takes the 78A-2-301(1)(a) fee of $375.00. The Utah Courts published schedule Filing Fees - Effective May 6, 2026 lists the same $375.00 for an original complaint or petition not otherwise governed, $35.00 for filing a probate or custody document of another state under (1)(m), $4.00 per certified document plus $0.50 per page under (1)(z), and $6.00 per exemplified document plus $0.50 per page under (1)(aa). The graduated ladder in 78A-2-301(1)(r) is introduced by the words "The fee for filing any accounting required by law is" and runs $15.00, $30.00, $50.00, $90.00 and $175.00 by estate value. That ladder is the fee to file an ACCOUNTING, which arises in supervised administration and in conservatorships, and it is not the fee to open probate. Both small-estate routes cost nothing: the 75-3-1201 affidavit is never filed with a court, and the 75-3-1203 summary administrative procedure closes an estate that was already opened. Section 78A-2-301(2) states there is no fee for a service or filing not listed in that section or otherwise provided by law, which is the statutory basis for those zero figures. Section 78A-2-301 carries an end date of January 1, 2027 and a successor version enacted by Chapter 378, 2026 General Session is already published; the $375.00, the $35.00 and the whole accounting ladder survive that change. Confirm the current amount with the clerk before filing.

Ongoing Estate Fees

Required Documents

  • Certified Death Certificate

    Order several certified copies from the Utah Office of Vital Records and Statistics, online, in person at a local health department for same-day service, or by mail. $35.00 for the initial certified copy and $10.00 for each additional copy of the same record ordered the same day (fee schedule effective July 1, 2026). Not a court form.

  • Original Will

    The custodian must deliver the original will with reasonable promptness, on the request of an interested person, to a person able to secure its probate (Utah Code § 75-2-902). Required only where the decedent left a will.

  • Application for Informal Probate and/or Informal Appointment of Personal Representative

    Filed with the district court in the county of the decedent's domicile. The clerk then mails notice to heirs and devisees and the registrar acts after 10 days from that notice.

  • Letters Testamentary or Letters of Administration

    Issued by the registrar on appointment; they prove the personal representative's authority.

  • Notice to Creditors

    Optional in Utah. Publishing once a week for three successive weeks in a county newspaper and for three weeks on the Utah Public Notice Website starts the three-month claim bar (Utah Code § 75-3-801).

  • Inventory and Appraisement

    Prepared within three months after appointment; sent to interested persons who request it, and optionally filed with the court (Utah Code § 75-3-705).

  • Small Estate Affidavit

    Not filed with the court. The successor completes it, signs before a notary, and presents it to the bank or other holder of the property. Utah publishes no court form number for it.

  • TC-569C Survivorship Affidavit (vehicles)(TC-569C)

    Presented to the Division of Motor Vehicles to retitle up to four boats, motor vehicles, trailers or semitrailers. The DMV also requires that there be no active lienholder on the vehicle.
