Small Estate Affidavit For estates under threshold (no court filing needed) | $0 |
Note: NEBRASKA'S PROBATE FILING FEE IS SET BY STATUTE FOR THE WHOLE STATE, SO NO COUNTY PUBLISHES ITS OWN SCHEDULE, AND THE STATUTE'S NUMBER IS NOT THE BILL. Neb. Rev. Stat. § 33-125 charges $22.00 for a probate commenced and closed informally, and a twenty-bracket scale of $22.00 to $1,500.00 on the gross value of the estate for a formal one. Two more statutes load onto every county court case and neither sits in chapter 33's probate section: § 24-703(3)(a) adds a sum equal to TEN PERCENT of the § 33-125 fee for the Nebraska Retirement Fund for Judges, and six per-case cost statutes add exactly $20.00 (§ 33-107.01 legal services $6.25, § 33-107.03 court automation $8.00, § 33-154 training $1.00, § 33-155 dispute resolution $0.75, § 33-156 indigent defense $3.00 and § 47-633 uniform data analysis $1.00). So an informal probate collects $44.00, or $45.00 testate, and a formal probate collects $44.00 to $1,670.00. Publishing $22.00 as "the Nebraska probate filing fee" understates it by half. § 33-126.03 charges $22.00 for a petition to determine inheritance tax, waived where a formal § 33-125(1)(b) fee was already charged, and § 33-125(2) charges $10.00 plus $1.00 retirement where a petition is dismissed with no appointment or order. THE STATUTE'S OWN DECOY: § 33-125(1)(a) nests a remittance schedule ending "beginning July 1, 2025, twelve dollars" inside the $22.00, which is the slice the clerk forwards and not a charge anyone pays. One wrinkle: § 24-703 says the ten percent is rounded to the nearest even dollar while the judiciary schedule prints exact ten percent on every bracket including odd results, and the brackets here carry the schedule's figures, which is what a clerk collects. Publication of the creditor notice is a separate cost paid to a newspaper at the § 33-141(4) statutory line rate, fifty cents per line for the first insertion and 43.34 cents for each of the two subsequent ones.
