Do you need an attorney for probate in New Jersey?No lawyer required
New Jersey permits an executor or administrator to probate and administer an estate without an attorney. The Hunterdon County Surrogate's FAQ states it verbatim: 'You are not required to have an attorney to go through the probate or administration process. Many executors and administrators go through the process without one. The Surrogate's Court is here to guide you through the process itself.'
Uncontested probate at the county Surrogate is a short administrative visit. A caveat or dispute moves the matter to the Superior Court, Chancery Division, Probate Part, where counsel stops being optional in practice.
