Oklahoma probate is filed in the district court, and the forum is the same in all 77 counties. Unlike states that publish a fill-in probate packet, Oklahoma publishes almost nothing for a decedent's estate: the Administrative Office of the Courts prints a civil cover sheet, an Affidavit of Surviving Joint Tenant and little else, so the petition, the notice to creditors, the inventory and the final account are drafted to the statute rather than filled in on a court form. Service Oklahoma publishes the real numbered forms an estate needs, and they are all about vehicles.

Successor affidavit under Okla. Stat. tit. 58, § 393. No court filing and no fee.

Wait at least 10 days after the death. The affidavit goes to the bank, the transfer agent or the title official, not to the court. No Oklahoma agency publishes a general-purpose version, so the affidavit is drafted to recite the four statements in § 393(A). The holder who pays or delivers on a compliant affidavit is discharged as if it had dealt with a personal representative (§ 394).

Important Notes

  • -Oklahoma probate is filed in the DISTRICT COURT in all 77 counties. There is no separate probate court, no probate division and no county-by-county forum question. Okla. Stat. tit. 58, § 1 gives the district court the probate jurisdiction, and venue is the county where the decedent lived at death (§ 5).
  • -The Administrative Office of the Courts publishes 22 categories of downloadable forms and NONE of them is probate. The categories are ADR and Early Settlement Mediation, Bail Bondsmen, Certified Courtroom Interpreters, Certified Shorthand Reporters, Court Clerks, Domestic and Family Law, Garnishment, Guardianship, Hearing on Assets, Inmate Forms, Judges, Judgments, Judicial Orders, Low-Point Beer Permits, Military Service Affidavits, Premarital Counseling, Private Process Server, Protective Orders, Personal Property, Real Property, Transfer From Small Claims to Civil Docket, and Unlawful Entry and Detainer. That list was read in full on 2026-09-02.
  • -Because there is no probate packet, the petition, the notice to creditors, the inventory, the final account and the closing petition are DRAFTED to the statute rather than filled in. Title 58 prescribes what each one must contain, which is why every entry above with a null form number still carries an official statutory URL.
  • -Do not go looking for a numbered Oklahoma probate form. Any page that names one is describing another state. The only numbered forms an Oklahoma estate uses are the Service Oklahoma motor vehicle forms, and the only named court forms are the Civil Cover Sheet and the Affidavit of Surviving Joint Tenant.
  • -The Guardianship category on the Administrative Office of the Courts forms page is a link OUT to the Oklahoma Bar Association Access to Justice guardianship materials at okbar.org. The Oklahoma Supreme Court's own page carries a notice that it does not endorse the contents of a third-party website.
  • -The court filing fee is flat statewide. A probate or guardianship petition is $135.00 under Okla. Stat. tit. 28, § 152(A)(3), and mandatory statutory add-ons bring the counter total to about $188.00, or about $195.00 once the $7.00 dispute-resolution court cost under Okla. Stat. tit. 12, § 1809(A) is included. A county may add a security assessment of up to $10.00. Oklahoma has no probate tax and no value-based filing fee.
  • -A certified copy from the court clerk is TWO charges, not one: $1.00 for the first page of the copy plus $0.50 for each subsequent page, and then $0.50 to certify the instrument (Okla. Stat. tit. 28, § 31). Authentication is $5.00.
  • -The Oklahoma Statutes application and the court directory on oscn.net sit behind an intermittent Cloudflare challenge, but the FORMS surfaces do not. Every forms URL on this page answered a plain request with real content on 2026-09-02. If a statute page challenges you, the same text is in the Legislature's complete-title PDF.
  • -The summary administration ceiling is $300,000, not $200,000. Laws 2026, HB 2650, c. 97, § 1 raised it, and the enrolled bill prints the change as a strike and insert. The Legislature's Title 58 compilation is current only through the 2025 session, so a form or a page built from that PDF is behind.
  • -Oklahoma publishes no statewide petition form and no self-help probate walkthrough, and the Oklahoma Bar Association does not refer attorneys to consumers. The practical self-help surfaces are the OSCN forms index, the OSCN docket search, and the Bar's consumer pamphlets.
