McIntosh County District Court Guide

Note: Fees per Okla. Stat. tit. 28, § 152 (flat statewide amounts; last amended by Laws 2025, c. 87, eff. Nov. 1, 2025). Section 152(A) makes the flat fees the only charge for court costs except as otherwise specifically provided by law, so McIntosh County sets no probate filing fee of its own and Oklahoma has no value-based probate fee and no probate tax. The petition fee for probate and guardianship is $135.00 (§ 152(A)(3)); a petition for summary administration under Okla. Stat. tit. 58, §§ 245-247 is a probate filing and takes the same $135.00 flat fee, and a proceeding for sale or lease of property or a mineral interest is $43.00 (§ 152(A)(5)), a proceeding to revoke the probate of a will is $43.00 (§ 152(A)(6)), and a judicial determination of death is $58.00 (§ 152(A)(7)). Mandatory statutory add-ons collected with the filing are $25 for the Oklahoma Court Information System (§ 152(C)), $6 for the Law Library Fund (§ 152(B)), $10 for OCASA (§ 152(D)), $2 for the Council on Judicial Complaints and the Supreme Court (§ 152(E)), and a $10 Court Clerk's Records Management fee assessed until November 1, 2027 (§ 152(G)), plus a $7.00 dispute-resolution court cost in all civil cases (Okla. Stat. tit. 12, § 1809(A)). Together those mandatory amounts put the common statewide opening total at about $195 ($135 + $53 + $7); that total is our arithmetic, not a single published figure, and it drops by $10 when § 152(G) sunsets. A county may also add a courthouse-security assessment of up to $10 per case by board resolution (§ 152(F)); whether McIntosh County has adopted one was not verified. The small estate successor affidavit is $0 because it is never filed with the court (Okla. Stat. tit. 58, § 393). Certified copies from the court clerk are $1.00 for the first page and $0.50 for each subsequent page, $0.50 to certify an instrument, and $5.00 to authenticate court records (Okla.
