Petition for Probate Standard probate filing fee | $135 |
Small Estate Affidavit For estates under threshold (no court filing needed) | $0 |
Note: Fees per Okla. Stat. tit. 28, § 152. Oklahoma sets court filing fees statewide as flat amounts, and § 152(A) makes them the only charge for court costs except as otherwise specifically provided by law, so there is no per-county probate filing fee and no value-based probate fee or probate tax in any county. The flat filing fee for a probate or guardianship petition is $135.00 under § 152(A)(3). Mandatory statutory add-ons collected with it are $25 for the Oklahoma Court Information System (§ 152(C)), $6 for the Law Library Fund (§ 152(B)), $10 for OCASA (§ 152(D)), $2 for the Council on Judicial Complaints and Supreme Court (§ 152(E)), and a $10 Court Clerk's Records Management fee assessed until November 1, 2027 (§ 152(G)), plus a $7 dispute-resolution court cost in all civil cases (Okla. Stat. tit. 12, § 1809(A)). That puts the common statewide opening total at about $195, an arithmetic total rather than a single published figure, and it drops by $10 when the § 152(G) surcharge sunsets on November 1, 2027 unless extended. The board of county commissioners may also adopt a sheriff's courthouse-security assessment of up to $10 per case under § 152(F), which is the one amount that can differ by county; whether this county has adopted it was not confirmed in this pass. A proceeding for sale or lease of property or a mineral interest is $43 (§ 152(A)(5)) and a proceeding to revoke the probate of a will is $43 (§ 152(A)(6)). Certified-copy charges are set by § 28-31: $1.00 for the first page and $0.50 for each subsequent page of a copy, $0.50 to certify an instrument, and $5.00 to authenticate court records. The small estate successor affidavit costs nothing at the courthouse because it is never filed with the court (Okla. Stat. tit. 58, § 393). Section 28-152 was last amended by Laws 2025, c. 87, effective November 1, 2025. Confirm the county-collected total with the court clerk before filing.
