Note: OREGON'S PROBATE FILING FEE IS BANDED BY THE VALUE OF THE ESTATE AND IS THE SAME IN EVERY COUNTY. There is no single number, and publishing one is a live error. The petition for appointment of a personal representative costs $278 where the estate is worth less than $50,000, $591 from $50,000 to under $1 million, $882 from $1 million to under $10 million, and $1,176 at $10 million or more (ORS 21.170(1)(a) to (d)). Each annual or final accounting costs $35, $298, $591 or $1,176 on the same four bands (ORS 21.170(2)), so an estate that stays open for several years pays an accounting fee more than once. An appearance in a probate proceeding pays the $281 standard filing fee (ORS 21.135(1), applied by ORS 21.170(4)). Filing a SIMPLE ESTATE AFFIDAVIT costs $124 under ORS 21.145, which ORS 114.515(5) applies to the affidavit, and by the express closing clause of that subsection an AMENDED simple estate affidavit is free. ORS 21.170(5) says in terms that this schedule also applies to the six county courts that exercise probate jurisdiction, so no Oregon county charges a different probate filing fee. Every figure was read at the 2025-edition statute on 2026-08-25 and corroborated row by row against the Oregon Judicial Department circuit court fee schedule effective 2026-01-01, which prints its own ORS authority beside each amount.
