Probate Filing Fees

Filing TypeFee
Small Estate Affidavit
For estates under threshold (no court filing needed)
$124

Note: IT DOES NOT COST ONE FIXED AMOUNT TO OPEN AN OREGON PROBATE, and any page that prints a single number for it is wrong. ORS 21.170(1) bands the fee for a petition to appoint a personal representative by the VALUE OF THE ESTATE: less than $50,000 costs $278; $50,000 or more but less than $1 million costs $591; $1 million or more but less than $10 million costs $882; $10 million or more costs $1,176. Each annual or final accounting costs $35, $298, $591 or $1,176 on the same four bands under ORS 21.170(2), so an estate that stays open for several years pays that more than once. An appearance in the proceeding costs the $281 standard filing fee (ORS 21.135(1), applied by ORS 21.170(4)). Filing a SIMPLE ESTATE AFFIDAVIT costs $124 under ORS 21.145 as applied by ORS 114.515(5), and an AMENDED affidavit is free by the express closing clause of that subsection. Every one of these amounts is identical in all 36 Oregon counties: ORS 21.170(5) says in terms that the schedule applies to county courts exercising probate jurisdiction, so the six county-court counties charge exactly what the 30 circuit-court counties charge. Figures read at the 2025-edition statute on 2026-08-25 and corroborated line by line against page 13 of the Oregon Judicial Department circuit court fee schedule effective 2026-01-01, which prints its own ORS authority on every row. The amendment chain for ORS 21.170 ends 2019 c.605 s.5, outside the 18-month re-read window.

ORS 113.155

NO JOSEPHINE COUNTY NEWSPAPER OF RECORD IS NAMED HERE, and that is a deliberate null rather than a gap. ORS 113.155 requires publication of the notice to interested persons but names no paper, and no official county or court list of designated legal newspapers for this county was found at a primary source in this pass. Naming a paper without one would be a fabrication a reader would act on and pay for. Ask the Josephine County Circuit Court or the county's Supplementary Local Court Rules, which are published per county at the Oregon Judicial Department Rules Center.
