ORS 21.170(1) bands the fee for a petition to appoint a personal representative by the VALUE OF THE ESTATE: less than $50,000 costs $278; $50,000 or more but less than $1 million costs $591; $1 million or more but less than $10 million costs $882; $10 million or more costs $1,176. Each annual or final accounting costs $35, $298, $591 or $1,176 on the same four bands under ORS 21.170(2), so an estate that stays open for several years pays that more than once. An appearance in the proceeding costs the $281 standard filing fee (ORS 21.135(1), applied by ORS 21.170(4)). Filing a SIMPLE ESTATE AFFIDAVIT costs $124 under ORS 21.145 as applied by ORS 114.515(5), and an AMENDED affidavit is free by the express closing clause of that subsection. Every one of these amounts is identical in all 36 Oregon counties: ORS 21.170(5) says in terms that the schedule applies to county courts exercising probate jurisdiction, so the six county-court counties charge exactly what the 30 circuit-court counties charge.
