Real Estate
Often outside probate
First records to pull
- Recorded will or certified copy of probate if any
- Affidavit of heirship where appropriate
- Certified death certificate
- County Register of Deeds recording
Tracker notes
- Pull the recorded deed before deciding whether administration is needed.
- Deeds and estate documents are recorded with the county Register of Deeds, a separate office from the probate clerk.
- Even though real estate vests at death, keep it available for creditor claims until the estate's debts are resolved.
