Note: Wyoming has NO probate tax and no per-county filing fee. The clerk of district court collects $110 original filing fee plus a $40 court automation fee and a $10 indigent civil legal services fee, each "in addition to the original filing fee" (W.S. 2-2-401(a)(i), (iii), (iv)): $160 to open. A value-based fee is added when the inventory is filed (W.S. 2-2-401(a)(ii)). Do not cite the civil fee statute W.S. 5-3-206(a)(i) for probate: its $160 already includes the $40 and $10. The court may assess additional fees for particular matters (W.S. 2-2-401(c)). The Supreme Court's Rules for Fees and Costs for District Courts, Rule 6, points probate fees to W.S. 2-2-401. The Big Horn County clerk of district court's own fee page (https://www.bighorncountywy.gov/departments/clerk-of-district-court/filing-fees, read 2026-09-28; _sources key county_codc_fees) lists the same $160 probate total.

Required Documents

  • Certified Death Certificate

    $25 for the first copy and $20 for each additional copy in the same request. Wyoming is a closed-record state: only immediate family, their lawyer, or a person such as an executor, bank or insurer who shows the need may order.

  • Original Will

    The custodian must deliver it to the clerk of district court or the named executor within 10 days of learning of the death.

  • Petition for Probate of Will and Letters Testamentary, or Petition for Letters of Administration

    Filed with the clerk of district court in the county of residence; $160 to open (W.S. 2-2-401).

  • Notice of Probate (with notice to creditors)

    Statutory form printed in W.S. 2-7-201; published once a week for 3 consecutive weeks and mailed under W.S. 2-7-205.

  • Inventory

    Sworn inventory due within 120 days of appointment (75 days after admission of the will where the elective share applies).

  • Final Report and Accounting and Petition for Distribution

    Filed under oath with the clerk and set for hearing; notice under W.S. 2-7-204 and 2-7-205.
