What Is Intestate Succession?

Intestate succession is the legal process that determines who inherits when someone dies without a valid will. Each state has its own rules that prioritize close family members in a defined order: spouses, descendants, parents, siblings, and so on.

Community Property States

California and Texas are community property states. Assets acquired during marriage are treated differently from separate property, so spouse and descendant shares can vary by asset type. The calculator breaks those categories out instead of forcing a single percentage.
