Note: Opening a formal or informal probate costs $166.00 in every county: Idaho Rules of Civil Procedure Appendix "A" (Effective July 12, 2024), Magistrate Division category A, items "5. Petition for formal probate" and "6. Application for informal probate", Total 166.00. The legal basis is a stack of four statutes: $120 under Idaho Code 31-3201A(1) for a case assigned to the magistrate division, $26 under 1-2003(1), $10 under 73-213, and the $10 civil-case administrative surcharge in 31-3201(3). THE SUBDIVIDED AMOUNTS INSIDE 31-3201A(1) (the $23 district court fund share, the $80 court technology fund share, the $6 senior magistrate judges fund share) ARE REMITTANCE SPLITS, NOT FEES. Never publish $120 or $156 as the probate filing fee. Category D "Summary administration of small estates" totals $130.00; 1-2003 and 73-213 each exempt a proceeding under the summary administration procedure for small estates, but whether that row also covers the 15-3-1205 surviving-spouse petition is not stated in the schedule or the statutes. Idaho has no probate tax.

Required Documents

  • Certified Death Certificate

    $16.00 per certified copy from the Idaho Bureau of Vital Records and Health Statistics, ordered online through VitalChek or by mail; there is no public counter. Not a court form.

  • Original Will

    Delivered with reasonable promptness to someone able to probate it, or to a court (15-2-902).

  • Application for Informal Probate and/or Informal Appointment

    Filed with the district court in the county of domicile; filing fee $166.

  • Letters Testamentary or Letters of Administration

    Issued on appointment; they prove the personal representative's authority.

  • Information to Heirs and Devisees

    Sent by ordinary mail within 30 days after appointment (15-3-705).

  • Notice to Creditors

    Optional. Publishing once a week for three successive weeks starts the four-month bar (15-3-801).

  • Inventory and Appraisement

    Within three months after appointment; filing it with the court is optional (15-3-706).

  • Small Estate Affidavit

    Presented to the bank or other holder, not filed with the court (15-3-1201).

  • ITD 3414 Affidavit of Inheritance (vehicles)(ITD 3414)
