Probate Filing Fees

Filing TypeFee
Petition for Probate
Standard probate filing fee
$166

Note: Idaho court fees are set statewide, so this is the same figure in every county. Opening a formal or informal probate costs $166.00: Idaho Rules of Civil Procedure Appendix "A" Filing Fee Schedule (Effective July 12, 2024), Magistrate Division category A, items "5. Petition for formal probate" and "6. Application for informal probate", Total 166.00. The legal basis is Idaho Code 31-3201A(1) ($120 for a case assigned to the magistrate division), 1-2003(1) (+$26), 73-213 (+$10) and the 31-3201(3) administrative surcharge (+$10). The other amounts inside 31-3201A(1) are remittance splits, not fees. Category D "Summary administration of small estates" totals $130.00; whether that row also covers a 15-3-1205 surviving-spouse petition is not stated in the schedule or the statutes. Petition for distribution $25, accounting $9, demand for notice $9, filing a copy of a foreign personal representative's appointment $27, and an initial appearance by anyone other than the petitioner $136 (Appendix A, categories I and J). Idaho has no probate tax. Confirm the amount with the clerk before filing.
