The legal basis is a stack of four statutes: $120 under Idaho Code 31-3201A(1) for a case assigned to the magistrate division, $26 under 1-2003(1), $10 under 73-213, and the $10 civil-case administrative surcharge in 31-3201(3). THE SUBDIVIDED AMOUNTS INSIDE 31-3201A(1) (the $23 district court fund share, the $80 court technology fund share, the $6 senior magistrate judges fund share) ARE REMITTANCE SPLITS, NOT FEES. Never publish $120 or $156 as the probate filing fee. Category D "Summary administration of small estates" totals $130.00; 1-2003 and 73-213 each exempt a proceeding under the summary administration procedure for small estates, but whether that row also covers the 15-3-1205 surviving-spouse petition is not stated in the schedule or the statutes. Idaho has no probate tax.
