Do you need an attorney for probate in Florida?Depends on the path

Florida REQUIRES an attorney for formal probate in nearly every real case: Rule 5.030(a) mandates counsel for every personal representative unless the PR is the sole interested person (no other beneficiaries or known creditors). Disposition without administration and some summary administrations can proceed without counsel.

  • Every personal representative must be represented by an attorney admitted to practice in Florida, UNLESS the personal representative remains the sole interested person. (Fla. Prob. R. 5.030(a))
  • A personal representative who is an attorney admitted in Florida may represent themselves. (Fla. Prob. R. 5.030(a))

If anyone besides you inherits or is owed money by the estate, Florida courts will expect an attorney on the filing. The exception is genuinely narrow.

Presumed reasonable under Fla. Stat. 733.6171: $1,500 for estates up to $40,000; plus $750 for $40,000-$70,000; plus $750 for $70,000-$100,000; 3% of value over $100,000 up to $1 million; 2.5% from $1 million to $3 million; 2% from $3 million to $5 million; declining above. The schedule is presumed reasonable and is subject to negotiation. On a $400,000 estate it is about $12,000.
