Intestate
Dying without a valid will.
What Intestate means in an estate
When someone dies intestate, the state's statute decides who inherits and in what shares. The estate may still have to go through probate, but the distribution follows the statute rather than the person's wishes. A will that is found invalid produces the same result.
How this works in your state
The concept is national, but the forms, procedure names, thresholds, and filing practice vary by state. Open your state glossary and guides to see how intestate is handled where the estate is being settled.
